Thrive operates in accordance with applicable data protection regulations. Clients are responsible for ensuring their outreach activities comply with:

GDPR / UK GDPR

PECR (Privacy & Electronic Communications Regulations)

CAN-SPAM (where applicable)

Other regional laws

Thrive accepts no liability for client misuse of data.

6. Payments & Fees

Fees are outlined in your proposal, package, or agreement

Payments must be made according to agreed terms

Late payments may result in service suspension

All fees are non-refundable unless otherwise stated.

7. Intellectual Property

All website content, branding, systems, and materials remain the property of Thrive unless explicitly agreed otherwise.

Clients retain ownership of their brand assets and messaging.

8. Service Availability

We aim to provide uninterrupted service but do not guarantee continuous availability. Maintenance, updates, or technical issues may cause temporary disruptions.

9. Limitation of Liability

Thrive shall not be liable for:

Indirect or consequential losses

Loss of profits, revenue, or opportunities

Outcomes dependent on third-party platforms

Our total liability shall not exceed the fees paid for the Service.

10. Confidentiality

Both parties agree to maintain confidentiality of proprietary, commercial, and sensitive information.

11. Termination

We reserve the right to suspend or terminate services if:

Clients may terminate based on agreed notice periods.

Outreach campaigns may rely on third-party platforms (email providers, CRMs, etc.). Thrive is not responsible for platform outages or policy changes.

13. Amendments

We may update these Terms & Conditions at any time. Continued use of the website or services constitutes acceptance of any revisions.

 

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Scotland.
